Last week I had the pleasure of speaking at the Connecticut AWWA’s annual conference. There I shared a the stage with a team from Providence Water, who told the story of their city’s struggles with lead contamination in drinking water. One of the most surprising things about Providence’s experience is the way that its customers apparently responded to the Flint water crisis.
Lead in Providence
Lead contamination in drinking water is a long-standing problem in Providence. Like many older American cities, Providence has many buildings with lead plumbing. As in Flint, Providence’s water system requires careful corrosion control in its treatment process to limit the release of lead into the drinking water supply. Lead contamination has been detected consistently in Providence’s water system since testing began in 1992—usually hovering just below EPA’s action level of 15 ppb—but it spiked to 30 ppb in 2009 and again in 2013, prompting increased regulatory scrutiny.* According to last week’s presentation, at least one Providence test site yielded lead contamination greater than 200 ppb—far higher than the levels that sparked outrage in Flint. Unlike Flint, where leaders denied and obfuscated lead contamination, Providence has publicly acknowledged and taken steps to address the issue: they’ve changed maintenance protocols and treatment methods, and introduced programs to replace lead service lines in its system.
As part of that effort, in 2014 Providence Water began offering drinking water lead testing for $10 to any customer who wanted it (earlier this year they started offering testing for free). In providing this service the utility also gathers valuable data on its own system. Initial participation in this voluntary testing regime was moderate, with an average of 4.7 customers requesting testing each month over the first two years of the program.
Then something unexpected happened in 2016: Participation in Providence’s lead testing program skyrocketed—after the Flint Water Crisis grabbed national headlines. Water contamination in Flint made Americans everywhere reconsider what comes out of their own taps. The figure below plots monthly voluntary lead testing in Providence from 2014-2017 (blue line); the utility mails its testing brochure in the May/June billing cycle, and so testing jumps in June and July each year.** The graph also shows monthly average Google News Index for coverage of the lead crisis in Flint (red line). Providence Water’s own lead contamination issues emerged in 2009, but when Flint put drinking water into the national spotlight in 2016, Providence citizens took action locally.
Are the people of Providence responding to events in Flint? It’s impossible to be certain, but the circumstantial evidence is strongly suggestive. A lead crisis 700 miles away apparently caused a 400% increase in lead testing participation by focusing Rhode Islanders’ attention on the contamination that they’d been living with for decades.
The water crisis in Flint is the Cuyahoga River fire of our generation: an event that thrust a widespread but underappreciated problem into the national consciousness. Political scientists call these focusing events: harmful, high-profile occurrences that suddenly put previously obscure issues onto the public policy agenda. One important consequence of the newfound attention to drinking water quality is that citizens everywhere think differently about their own utilities and drinking water. They may not deserve it, but utilities everywhere must now grapple with the Flint Water Crisis’ awful legacy. The effects of the Flint Water Crisis on the people of Providence, Rhode Island show such events afar can transform citizens’ interactions with their own local governments.

On the proliferation of water conferences
I like conferences. That’s a good thing, because academics attend a lot of conferences. The conference circuit is especially busy for those of us who do significant interdisciplinary and applied research. As a political scientist who works on public management and water policy, that means 1-2 political science conferences (APSA, MPSA, SPSA), 1-2 public administration/public policy conferences (APPAM, PMRC, ASPA), and 1-2 water conferences.
Water conferences are a bit different, because they’re attended mostly by more working professionals than academics. Interacting with people who grapple with real policy, political, and management challenges generates new research questions, empirical studies, and theoretical developments. Water conferences connect people who work on water resources, drinking water, stormwater management, wastewater treatment, reuse, desalination, construction, finance, law, conservation, environmental justice, and more—each of these topics is inextricably linked to the others. Water conferences are terribly important for scholars because they facilitate interaction across disciplinary silos and make our research relevant. Academics are important for water conferences because they get the latest, most rigorous research into the hands of managers, advocates, and policymakers.
Water conferences: so many, so costly
I have no trend data, but it feels like water conferences have proliferated over the past decade. I’ve been attending ACE and UMC for years, but every week my email and twitter feed tell me about another conference meeting where utility leaders, scholars, engineers, analysts and advocates are talking about water.
Just as the nation is rediscovering water’s importance, so apparently have conference organizers. There are dozens of water-focused conferences each year in the United States alone. I quickly catalogued the conferences that would be relevant for my own work on urban water policy, management and finance in the United States. I didn’t include conferences that are principally academic. Looking only at national conferences in 2018 here’s what I found:
That’s eleven national conferences with an average registration fee of $680…. and that’s just general policy/management conferences. For people who work on the technical side of the water business, there are many more. In most cases, the volunteers who plan and present at conferences also have to pay registration fees. Combined with travel costs, those fees strain meager public sector and academic conference budgets.
The perils of proliferation
Not everyone has to attend every conference, there is a place for specialized conferences, and it’s good that meetings are available at various times of year. Still, I can’t shake the uneasy feeling that we’ve passed the socially optimal number of conferences in the water sector.
To be valuable, professional conferences rely on network economies and/or economies of agglomeration: the benefit of any conference is a function of the number and variety of other attendees. Water conferences are most valuable if they provide participants access to people and information that they otherwise wouldn’t encounter. At some point, an increasing number of conferences dilutes their value to individuals, organizations, and the water community at large.
Water organizations make big money through conferences, but collectively they may have reached a point of diminishing returns to the water community.
Who shall pay? is the perennially vexing refrain for would-be providers of public goods. Everyone likes nice things; no one likes to pay for them. In 2012 the State of California declared that drinking water is a human right, and as I’ve observed before, turning such lofty rhetoric into safe and affordable water at the tap is no easy thing. Figuring out how to pay for it all is perhaps the hardest part.
Addressing some water affordability challenges involves reducing household-level costs of water service, and my last post considered the possibility of providing for water affordability through rate design. But sometimes the challenges are more systemic: in California and across the United States, small, rural communities receive inadequate and often unaffordable water. Bringing small systems into compliance with drinking water standards is crucial to making the human right to water a reality—and everyone agrees that it won’t be cheap.
SB-623: The Safe & Affordable Drinking Water Fund
Last year, California Senator Bill Monning and several cosponsors introduced SB-623 to create a Safe and Affordable Drinking Water Fund. This Fund would give $140 million annually to the State Water Resources Control Board (SWRCB), which would in turn channel those funds to failing water systems. Such a massive injection of capital and operating funds would go a long way toward making safe drinking water affordable to California’s rural communities.
To generate that revenue, SB-623 would impose fees on fertilizers, dairy products, and—most controversially—water bills. The fee would be $0.95 per month for most residential water customers, and low-income households would be exempt. The fees would be collected by water utilities and then transferred to the SWRCB for reallocation to struggling water systems.
Funds, Fees & Taxes
In addition to generating significant and badly needed revenue, SB-623’s funding mechanisms include important guards against what political scientists call coalitional drift—the idea that future governments will have different priorities from the present government, and so undo the policies established today. The Safe & Affordable Drinking Water Fund would be institutionally separate from the state’s general fund, and have dedicated revenue sources instead of relying on the conventional income, property, and/or sales taxes. In that way, the Fund would be resistant to efforts by future politicians to cut the program in the event of an economic downturn or fiscal crisis.
Opponents of SB-623 decry the $0.95 monthly fee as a “water tax”—an accurate claim, since the fee is not associated with the cost of the customer’s water service. Rather than paying for rural water system support through this new water tax, a coalition of SB-623 opponents—mostly local government water utilities—propose an alternate solution that would generate hundreds of millions of dollars, mainly through tax-funded state water bonds and general fund revenue.
There is apparently broad consensus in California that significant new funding is necessary to solve the problems of failing small water systems. In this case, who shall pay is clear: whether funded through a water tax or state general funds, the people of California will have to pay the money needed to help failing water systems. The conflict is over who will collect it.
SB-623 would turn California’s water utilities into tax collectors. Across the United States, energy utilities and telecommunications companies already collect a variety of taxes on behalf of the government. That’s convenient for politicians, since it redirects citizen anger over taxes away from government and toward utility companies.
But since a large majority of Californians get their drinking water service from local government utilities, paying for a Safe & Affordable Drinking Water Fund through a water utility tax would shift the political costs of affordable water away from the state legislature and toward local boards and councils.
Tax collectors are no more popular today than they were in first century Palestine. Instead of seeing their tax bills increase, citizens would see their water bills increase and (understandably) associate the increase with the governments whose logos are at the top of the bills. The citizen wrath that would have been focused on the statehouse will instead be aimed at city halls and water district boardrooms. That wrath will make it harder for local officials to build the political support they need for operations and maintenance of their own water systems.
When political costs > financial costs
There may be widespread agreement in California that water is a human right. But in a democracy, public policies that compel the majority to pay to help a vulnerable minority are always politically costly. California’s history of tax revolts give lawmakers, advocates, and utility leaders good reason to be wary about shouldering that political burden. The conflict of SB-623 reveals fault lines that are likely to appear elsewhere as states and communities grapple with the challenge of supporting failing water systems.
